1. General

These Terms and Conditions govern your use of our website, services, and products. EmmaLee Grace Photography reserves the right to update or change these terms at any time, and continued use of the website or services constitutes acceptance of these updates.

2. Bookings and Payments

• Deposits: A non-refundable deposit is required to secure your session date. The remaining balance is due on or before the session date unless otherwise agreed upon.
• Rescheduling and Cancellations: If you need to reschedule, please notify us at least 48 hours in advance. Deposits may be transferred to a new date at our discretion. Cancellations with less than 48 hours’ notice may result in the forfeiture of your deposit.
• Session Fees: Fees are agreed upon at the time of booking and are non-negotiable after confirmation.

3. Image Delivery

• Edited digital images will be delivered within the timeframe discussed during booking, typically 2-3 weeks. Rush delivery may be available for an additional fee.
• EmmaLee Grace Photography retains the right to determine which images are delivered. Raw, unedited files will not be provided under any circumstances.

4. Copyright and Usage

• All images taken by EmmaLee Grace Photography are the intellectual property of the photographer.
• Clients receive a license for personal use of delivered images, including sharing on social media or printing for personal purposes.
• Images may not be altered, edited, or used for commercial purposes without prior written consent from EmmaLee Grace Photography.
• EmmaLee Grace Photography reserves the right to use images for promotional purposes unless the client explicitly opts out in writing before the session.

5. Liability

• EmmaLee Grace Photography is not responsible for any injuries, damages, or losses that may occur during a session, whether at the chosen location or in transit.
• While we take great care in handling your images, EmmaLee Grace Photography is not liable for unforeseen events such as data loss, file corruption, or delayed delivery due to technical issues. In such cases, all efforts will be made to resolve the issue or re-schedule the session.

6. Client Responsibilities

• Clients are responsible for arriving on time and prepared for their session. Delayed arrivals may result in shortened session time without refund or rescheduling.
• Clients must ensure any locations or props used during the session comply with local laws and permissions.

7. Session Conditions

• EmmaLee Grace Photography reserves the right to end a session early if inappropriate behavior, unsafe conditions, or unforeseen circumstances arise.
• Reshoots are not guaranteed and will only be offered at the discretion of EmmaLee Grace Photography in the event of technical issues or photographer error.

8. Refund Policy

• Deposits are non-refundable under all circumstances. Full or partial refunds for completed sessions will only be considered in the event of a technical issue or other failure by EmmaLee Grace Photography.

9. Third-Party Services

This website may include links to third-party websites or services. EmmaLee Grace Photography is not responsible for the terms, privacy practices, or content of these external platforms.

10. Governing Law

These Terms and Conditions are governed by the laws of the state of Montana. Any disputes will be resolved exclusively in the courts of Montana.
